Chapter 5 of 9: Court, costs and settlement: Accept or reject
What does rejecting an assessment mean?
Checked 14 October 2026against sections 30, 31 and 51A of the Personal Injuries Assessment Board Act 2003, as amended by the Personal Injuries Resolution Board Act 2022 and the Central Bank's National Claims Information Database.
A Notice of Assessment gives you 28 days. If you reject a figure the respondent accepted and a court later awards no more, section 51A says no costs can be ordered in your favour and the respondent is treated as having offered that sum on the day it accepted. This page explains the rule for your figure. It does not tell you what to do.
Not the Board. InjuryWise is independent. Applications are made to the Injuries Resolution Board at injuries.ie; we never make or submit a claim. The Board’s own site is injuries.ie.
The Notice of Assessment: the figure, and whether the respondent has accepted it
This is the costs rule and the court tiers applied to a figure. It is not a recommendation, not a prediction of what a court would award, and not a view on liability or contributory negligence, which the Board never decides.
